Terms of Service

Welcome to EcoWaste. By accessing our website or using our waste pickup, recycling, and disposal services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you ("Customer," "you," or "your") and EcoWaste ("Company," "we," "us," or "our"). By scheduling a pickup, creating an account, or otherwise using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Description of Services

EcoWaste provides waste collection, recycling, and disposal services for residential, commercial, and industrial customers. Services include but are not limited to:

  • Curbside waste and recycling pickup
  • Bulk item and junk removal
  • Commercial bin and container services
  • Industrial waste hauling and disposal
  • Material recovery and recycling processing

Specific service details, frequency, and pricing are outlined in your service agreement or order confirmation.

3. Customer Responsibilities

To ensure safe and efficient service, you agree to:

  • Place bins or items at the designated collection point by the scheduled pickup time.
  • Ensure that waste is properly contained and does not exceed weight limits (typically 50 lbs per bin unless otherwise specified).
  • Not place hazardous materials, flammable substances, biological waste, or other prohibited items in regular collection bins. A list of prohibited items is available on our website.
  • Provide clear and safe access to the pickup location, free from obstacles, aggressive animals, or other hazards.
  • Notify us of any changes to your service address, contact information, or service needs at least 48 hours in advance.

4. Prohibited Items

The following items are strictly prohibited from regular waste collection and may require special handling or disposal arrangements:

  • Hazardous waste (paints, solvents, pesticides, motor oil, batteries)
  • Medical or biological waste (sharps, infectious materials)
  • Explosives, ammunition, or flammable liquids
  • Asbestos or other regulated building materials
  • Electronics containing hazardous components (unless scheduled for e‑waste pickup)

If prohibited items are found in your collection, we reserve the right to refuse pickup and may charge additional fees for handling or disposal.

5. Payment Terms

Service fees are as quoted in your plan or service agreement. Payment is due according to the billing cycle (monthly, quarterly, or annually) unless otherwise agreed. We accept major credit cards, ACH transfers, and corporate checks. Late payments may incur a fee of 1.5% per month or the maximum permitted by law. All fees are non‑refundable except as expressly provided in these Terms.

6. Cancellation and Termination

Residential month‑to‑month plans may be canceled at any time with notice at least 7 days before the next billing cycle. Annual plans canceled before the end of the term may be subject to an early termination fee. Business and industrial contracts have specific cancellation terms as detailed in your individual agreement. We reserve the right to suspend or terminate services immediately if you violate these Terms, fail to pay, or create a safety risk for our personnel.

7. Service Modifications and Availability

We strive to provide consistent, on‑time service. However, there may be occasions when collections are delayed due to weather, mechanical issues, road closures, or other circumstances beyond our control. We will make reasonable efforts to notify you of significant delays and reschedule promptly. We may also modify or discontinue certain service offerings with 30 days' notice to active customers.

8. Limitation of Liability

To the fullest extent permitted by law, EcoWaste shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our services. Our total liability for any claim related to the services shall not exceed the amount paid by you for the specific service giving rise to the claim during the 12 months preceding the event. This limitation does not apply to liability for death, personal injury, or gross negligence where such limitation is prohibited by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless EcoWaste, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of our services, your violation of these Terms, or your violation of any third‑party rights.

10. Intellectual Property

All content on the EcoWaste website, including text, graphics, logos, icons, images, and software, is the property of EcoWaste or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

11. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or our services shall be resolved exclusively in the state or federal courts located in Portland, Oregon. Both parties consent to the personal jurisdiction of such courts.

12. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices, legal requirements, or service offerings. The updated version will be posted on this page with a new "Last updated" date. We will notify active customers of material changes via email or through our website. Continued use of our services after such changes constitutes acceptance of the new Terms.
